Can my helper change employer in the middle of the contract?

We do our best to keep this updated as the rules change. Please cross-check with the relevant authority for the very latest details.

Generally no — the Immigration Department does not normally approve applications to change employer in Hong Kong within the 2-year contract. The helper would need to return to their place of origin and apply for a new visa from there.

However, exceptions are allowed (the change of employer can happen without the helper leaving HK) when: • The original employer cannot continue the contract due to external transfer, migration, death, or financial reasons • There is evidence the helper has been subjected to abuse or exploitation

After a premature termination, the helper has 14 days to find a new employer or leave Hong Kong (the "two-week rule"). The remaining time on their permitted stay caps the 14 days — whichever is earlier.
