How much annual leave is my helper entitled to?

We do our best to keep this updated as the rules change. Please cross-check with the relevant authority for the very latest details.

Annual leave entitlement under the Employment Ordinance scales with length of service:

• Years 1–2: 7 days per year • Year 3: 8 days • Year 4: 9 days • Year 5: 10 days • Year 6: 11 days • Year 7: 12 days • Year 8: 13 days • Year 9 onwards: 14 days (maximum)

The employer schedules the leave with at least 14 days' written notice unless the helper agrees to a shorter period. Annual leave must be taken within 12 months after it's earned and cannot be perpetually rolled over.

If employment ends before unused annual leave has been taken, the employer must pay it out in cash at the helper's daily-wage rate.
